CRICKET WARRANTY

If you have purchased a Cricket from us *Direct in Daytona Beach, FL., Congratulations! Our warranty form below must be submitted within 10 days to be in effect.

Limited Warranty
Cricket Mini Golf Carts, Inc. hereby warrants that new CRICKET vehicles purchased from direct from Cricket Mini Golf Carts, Inc., in the continental United States will be free from defects in material and workmanship for the period of time stated herein, subject to certain stated limitations. Cricket Mini Golf Carts, Inc. is not responsible for any abuse, negligence, vandalism, acts of nature or delivery damage if buyer accepts delivery.

The Period of Warranty
All CRICKET vehicles and batteries shall have a warranty period of 3 years from the date customer takes possession, or upon verified delivery of vehicle to customer’s designated delivery address.

During the Period of Warranty
Cricket Mini Golf Carts, Inc., will, free of charge, repair or replace, at its option, any part adjudged defective by Cricket Mini Golf Carts, Inc. during the warranty period due to faulty workmanship or material from the factory. Parts used in warranty repairs will be warranted for the balance of the product’s warranty period. All parts replaced under warranty become property of Cricket Mini Golf Carts, Inc.

General Exclusions
Exclusions from this warranty shall include any failures caused by:
a. Competition or racing use
b. Installation of parts or accessories that are not qualitatively equivalent to genuine Cricket manufacturer parts or accessories
c. Abnormal strain, neglect, or abuse
d. Lack of proper maintenance
e. Lack of charging batteries properly
f. Accident or collision damage
g. Modification to original parts
h. Damage due to improper transportation
i. Exceeding the 10% grade capabilities of the Cricket on hills, uneven ground, or roads.
j. Exceeding the stated capabilities of the Cricket in the owners manual.Please read owners manual.
k. Failure to properly engage braking lever in the rear of the Cricket.
l. 35% restocking fee on all authorized returned carts. Returned carts must be in working order and no mechanical failures.
m. Failure to use the tow or freewheel electronic switch properly while in use or towing Cricket.
n. No labor warranty or transporting to and from an authorized service location.
o. Shipping damage unless previously discussed with Cricket Mini Golf Carts, Inc. Must be notated on delivery bill of lading.
p. Improper charging of batteries. See battery charger manual.
q. Any cart bought from any other dealer that does not have affiliation with Cricket Mini Golf Carts, Inc. in Daytona Beach, FL.
r. Any part removed or disassembled unless previously discussed and/or authorized from Cricket Mini Golf Carts, Inc. in Daytona Beach, FL.

Specific Exclusions
Exclusions from this warranty shall include parts replaced due to normal wear or routine maintenance or computer faults, such as upholstery, light bulbs, and brake shoes, tires, hubs, motors, transaxles, bearings, bushings and batteries. Batteries are on a 2 yr warranty if properly maintained per charger manual. Must be brought to Cricket Mini Golf Carts for thorough computer diagnostic. If any or all stall warnings are present on computer diagnostic parts will not be covered.

The Customer’s Responsibility
Under this limited warranty, the customer’s responsibility shall be to:
a. Operate and maintain the vehicle as specified in the appropriate owner’s manual.
b. Charge batteries as recommended by Cricket Mini Golf Carts, Inc. Batteries are to be left on charger if cart is not in use. Allow charger to maintain, balance and float battery levels. (See charger manual) If batteries are left off charger for more than 10 consecutive days, battery warranty is void.
c. Give notice to Cricket Mini Golf Carts, Inc. of any and all apparent defects within ten (10) days after discovery, and make the vehicle available at that time for inspection and repairs at such authorized service center, or at Cricket Mini Golf Carts, Inc. in Daytona Beach, FL.

Warranty Transfer
To transfer the warranty from the original purchaser to any subsequent purchaser(s), the vehicle must be inspected and registered for warranty by Cricket Mini Golf Carts, Inc. In order for this warranty to remain in effect, this inspection and registration must take place within ten (10) days after transfer. (An inspection and registration fee will be charged for this service.)

Additional Warranty Information
Cricket Mini Golf Carts, Inc. makes no other warranty of any kind, expressed or implied. All implied warranties of merchantability and fitness for a particular purpose which exceed the obligations and time limits stated in this warranty are hereby disclaimed by Cricket Mini Golf Carts, Inc. and herewith excluded from this warranty.

Warranty Claim
Please call Cricket Mini Golf Carts, Inc. direct with any warranty claims, 1-888-RX5-CART, we will ship out parts direct to you or arrange for repairs at an authorized service center near you. If work is done at any dealership without prior permission or authorization from Cricket Mini Golf Carts, Inc, owner accepts all responsibility and repair charges.

Release of Liability
The purchaser understands that it is the sole duty of the purchaser to comply with, and insure compliance with, all necessary safety requirements and agrees to indemnify and hold harmless Cricket Mini Golf Carts, Inc of any and all liability, direct or indirect, arising from the use or misuse of the merchandise or any other action related to, or incidental to, the merchandise purchased by the purchaser. The purchaser agrees to allow no individual under the age of 16 to operate or otherwise use the merchandise purchased from Cricket Mini Golf Carts, Inc. Purchaser agrees to indemnify and hold harmless Cricket Mini Golf Carts, Inc from any claims of third parties, whether authorized by purchaser or not, arising from, related to, or incidental to this contract or the merchandise purchased pursuant to this contract. Any warranties made by Cricket Mini Golf Carts, Inc pursuant to this contract may not be transferred to third parties unless notified and inspected by an authorized representative of Cricket Mini Golf Carts, Inc.
